Patent agent information

All patent applications/submissions must be carried out by a registered patent agent (unless the application/submission is undertaken by a person who is ordinarily resident in the Bailiwick of Guernsey and wishes to be registered as the proprietor of a patent, or already is the proprietor of a registered patent).

Patent agents are registered under the Registered Patents and Biotechnological Inventions (Bailiwick of Guernsey) Regulations, 2012.

A person who wishes to register as a patent agent must be ordinarily resident in the Bailiwick of Guernsey and must be a 'qualifying person' under the regulations. 


Qualifying persons

'Qualifying persons' are as follows:

- An advocate

- A solicitor of the Supreme Court of England and Wales, Northern Ireland & Scotland

- A person entered on the register of Patent or Trade Mark Attorneys under the Copyright, Designs and Patents Act 1988

- A Corporate Service Provider (as described in The Companies (Guernsey) Law, 2008)

- Such person, who by reason of qualifications or experience, the Registrar determines to be a fit and proper person to act as an Agent for others under The Registered Patents and Biotechnological Inventions (Bailiwick of Guernsey) Ordinance, 2009.


How to apply to become an agent

To apply to become a registered patent agent you will need to complete an application form and return it to the IPO with the relevant fee.
