Image right agent information

All image rights applications/submissions must be carried out by a registered image rights agent (unless the application/submission is undertaken at the IPO in person by the personality or their personal representative).

Image rights agents are registered under the Image Rights (Bailiwick of Guernsey) Regulations, 2012.

A person who wishes to register as an image rights agent must be ordinarily resident in the Bailiwick of Guernsey and must be a 'qualifying person' under the regulations. 


Qualifying persons

'Qualifying persons' are as follows:

- An advocate

- A solicitor of the Supreme Court of England and Wales, Northern Ireland & Scotland

- A person entered on the register of Patent or Trade Mark Attorneys

- A director, manager or other similar officer of a Corporate Service Provider (as described in The Companies (Guernsey) Law, 2008) - who also has a QCF level 6 qualification in an appropriate subject or equivalent, as determined by the Registrar

- Such person, who by reason of qualifications or experience, the Committee, after consultation with the Registrar, determines to be a fit and proper person to act as a registered image rights agent.

The Registrar has issued rules regarding eligibility of directors, managers or other similar officers of CSPs under Regulation 5(f)(ii) and Regulation 5(f)(iii). The rules are available to view here.


Image Rights Agents Code of Practice

The Image Rights (Bailiwick of Guernsey) (Amendment) Ordinance, 2017 is due to go to the States meeting on 29th March 2017 and is intended to come into force on 1st April 2017. The Amendment Ordinance will enable the Committee for Economic Development to prescribe and amend a Code of Practice for Image Rights Agents.

How to apply to become an agent

To apply to become a registered image rights agent you will need to complete an application form and return it to the IPO with the relevant fee.
