Introduction of New Trade Mark Fees & Charges Regulations

Proposed for Implementation 1st September 2010

Following an extensive period of research and analysis, including consultation with industry during 2009, the Registrar of Intellectual Property has recently concluded the first comprehensive revision of trade mark fees & charges in the Bailiwick of Guernsey since the Office of the Registrar opened in 2006.

In association with Legal Counsel, the Fees & Charges Regulations as prescribed by the Commerce & Employment Department under s.76 of the Trade Marks Bailiwick of Guernsey Ordinance have been comprehensively revised.

It is anticipated that these Regulations will be presented to the Commerce & Employment Board for approval during the course of August 2010 with an anticipated implementation date of 1st September 2010 or as soon as possible thereafter.

In very brief summary the following points are amongst others, subject to agreement of the Department:

  • There will be no change to the fees & charges associated with online filing of trade mark submissions.
  • The fees for an application made by a registered charity will be waived in full and the application fee for a not-for-profit organisation will be significantly reduced.
  • The cost of a primary trade mark application in one Class remains unchanged.
  • There will be a £20 increase to the cost of filing a supported registration application in one Class.
  • The cost of filing additional Nice Classes over and above the first Nice Class in a new registration application will be raised from £10 to £20. This is considered to be a competitive rate as compares with other jurisdictions.
  • There will be no change to the cost of filing of an assignment providing all relevant documentation is provided and satisfactory at the time of filing.
  • Documents filed separately or subsequent to a request from the Registrar will incur a £10 filing fee.
  • The cost of altering particulars in the register ie. change of proprietor name & address will remain unchanged. However, the category of charge will be extended to include applications to change the details of the registered representative (‘agent’) in the Register.

The revised fees schedule will be published on this website and communicated directly to Professional Clients as far as possible in advance of the agreed implementation date.
