In order to support and promote the delivery of service to proprietors of Guernsey registered trade marks, the Registrar is pleased to release information to assist legal practitioners, IP specialists and representatives in managing and maintaining their clients’ Bailiwick trade mark protection.
The Registrar will continue to contact registered representatives directly with a ‘Renewals Due’ list stating the Guernsey registered marks that will fall due for renewal in the next 6 months. This will take place twice per year. The Registrar would also strongly recommend that all representatives review the expired marks list below in order to ensure that any clients that have an interest in maintaining their protection in the Bailiwick can be contacted, advised and serviced accordingly.
The following lists of marks, which have recently expired from the register of Trade Marks in the Bailiwick of Guernsey, is therefore published for inspection. Subject to the date of expiry, action may still be available by way of restoration & renewal (See below Trade Mark Service Information).

• Trade Mark Register Search
The Registrar recommends that a search of the register be undertaken to determine the currently registered agent and all relevant registered details for the mark prior to filing of an appropriate application.
• Renewal
In order for protection of a registered trade mark to be effective in the Bailiwick it is necessary for a request for renewal to be made under s.43(3) of the Trade Marks (Bailiwick of Guernsey) Ordinance, 2006. The request for renewal together with the appropriate renewal fee must be paid before the expiry of the registration.
In circumstances where a mark has expired from the Register, it is possible to request renewal with payment of renewal fees and additional renewal fee (late renewal fees see Fees 7 Charges Regulations Schedule) during the first six months from the date of expiry of the mark from the Register.
• Restoration
Following this grace period, the expired mark will be removed from the Register by the Registrar. In order to renew a mark which has expired and been removed from the Register it is necessary to make a request to the Registrar for the restoration of the mark to the Register in accordance with s.43(5) and with a statement of reasons.

In some circumstances, where the registered representative has been advised that the trade mark right is due to expire and no application to renew has been received by the Guernsey IP Office, the Registrar may determine it appropriate to release correspondence directly to the registered proprietor. The Registrar will therefore indicate to the proprietor that their registered protection has expired in the Bailiwick and suggest that they contact their registered representative with appropriate instructions. In these circumstances, the proprietor will be informed who the registered representative is to ensure that the existing relationship may be maintained and avoid duplication.
