Regulations

These Regulations prescribe the fees and charges for the registration, renewal and other registration transactions for Trade Marks under The Trade Marks (Bailiwick of Guernsey) Ordinance, 2006. They also provide the Registrar with a power to waive or reduce fees after consultation with, and approval by, the Department.

These Regulations prescribe the Countries and Offices from which an oversea registered design may be registered in the Bailiwick under the Registered Designs (Bailiwick of Guernsey) Ordinance, 2005.

Office rules

The Bailwick's legislation (Laws or Ordinances) set out relevant intellectual property law in the jurisdiction as approved by the States of Deliberation.

As explained on the Legal Resources website, some Laws or Ordinances give a States Department the power to make regulations, orders or rules which have the force of law.  These are called Statutory Instruments.  They deal with matters of detail relating to the operation of a Law (or Ordinance). This is the case in each of the intellectual property ordinances.

Each of those ordinances sets out provisions for which regulations must be made and those aspects of the law for which regulations may be made at the Registrar's discretion with the approval of the Commerce & Employment Board, States of Guernsey.

The Office Rules are a collection of operating practices established by the Office of the Registrar of Intellectual Property to give effect to regulations as set out and approved in accordance with the relevant Ordinance.

Registrar's Notices serve to bring to the attention of clients any changes to or developments of the Office Rules. 

Members of the Intellectual Property Office team adhere to the Office Rules and treat applications and enquiries in accordance with those Office Rules.

At present the Office Rules are being revised and reformated for presentation and public access on this website.
