Since 2007 it has been possible for plant breeders who have developed new varieties of plants or seeds in the Bailiwick to apply to register their variety for protection here.

Under the Registered Plant Breeders' Rights (Bailiwick of Guernsey) Ordinance, 2007, the holder of a plant breeders' right is entitled to stop a third party without consent, from producing selling, importing or exporting plants and seeds that are given protection in law.

The Intellectual Property Office provides services in this area of intellectual property and relevant information can be provided upon request to the IP team by e-mailing ipo@guernseyregistry.com or calling the Guernsey Registry on +44(1) 1481 743800.

You may also like to consider registering the name of the new variety as a trade mark in the Bailiwick of Guernsey.
