There are a wide range of intellectual property rights for which protection is given under law in the Bailiwick of Guernsey.
This information button will provide a brief summary of the name and effect of the right and services that are currently available from the Intellectual Property Office or guidance about new services that will be released soon.
On 28th January 2009, the Guernsey States of Deliberation passed a resolution approving a new ordinance - the Patents and Biotechnological Inventions (Bailiwick of Guernsey) Ordinance, 2009. The services associated with this new law are being developed for release during the last quarter of 2009. In future, it will be possible to obtain protection in the Bailwick of Guernsey for a patent or biotechnological invention for which grant has been made in another jurisdiction recognised by the Bailiwick. These services will be made available through administrative processes undertaken at the Intellectual Property Office.
It is currently possible to obtain patent protection in the Bailiwick of Guernsey. Until the new law comes into effect, the department called The Greffe continues to be responsible for judicial processes in relation to applying for a patent in the Bailiwick of Guernsey. There are two important points to consider in order to bring a UK granted patent to this jurisdiction -
1 The patent you wish to bring to the Bailiwick of Guernsey will first have to have been granted in the United Kingdom by the UK IPO
2 You will require a legal representative to present your patent before the Royal Court in Guernsey in accordance with the existing judicial process.
