Copyright Consultation
Purpose and type of consultation
The Intellectual Property Office carried out a consultation on behalf of the Commerce & Employment Department to consider the repeal of the special provisions for clubs and societies which provide exemption from copyright in playing or broadcasting of sound recordings for the reasons set out in this consultation document. If the sections are repealed those clubs, societies and organisations currently enjoying the benefit of the sections will, in practice, need to obtain licences authorising the playing or broadcasting of sound recordings which are the subject of copyright.
Sections 88 and 93(3)(a) of the Copyright (Bailiwick of Guernsey) Ordinance, 2005 prescribe circumstances in which the playing or broadcasting of sound recordings by certain clubs, societies and organisations does not infringe the copyright in those recordings.
The consultation and subsequent work is intended to provide sufficient information so that all individuals and groups are clear about the issues raised, the implications to them.
This Consultation closed on 30th September 2011 and no further responses are sought.
The report and recommendations will be released for information purposes on this website as soon as the final stages of the project have been completed.
