Bailiwick Image Rights Agents Information

Any application or submission regarding an Image Right in the Bailiwick of Guernsey must be carried out by a registered Image Rights Agent unless the application or submission is undertaken at the Intellectual Property Office by the personality themselves or their personal representative.

The Registrar keeps and maintains a register of Image Rights Agents having assessed an application from a qualifying person (s) and payment of the relevant fee. All agents, as well as meeting the qualifying person criteria must  also be ordinarily resident in the Bailiwick of Guernsey and have a business address in the Bailiwick.


Qualifying persons are as follows:

- An advocate.

- A solicitor of the Supreme Court of England and Wales, Northern Ireland & Scotland

- A person entered on the register of Patent or Trade Mark Attorneys.

- A director, manager or other similar officer of a  Corporate Service Provider (as described in The Companies (Guernsey) Law, 2008) - who also has a NQF level 6 qualification in an appropriate subject or equivalent, as determined by the Registrar.

- Such person, who by reason of qualifications or experience, the Registrar determines to be a fit and proper person to act as an Agent for others under The Image Rights (Bailiwick of Guernsey) Regulations, 2012

The Registrar has made rules for Agent applications under the Image Rights (Bailiwick of Guernsey) Regulations 2012 regarding 'qualifying persons' as follows:

Rule made under Regulation 5 (f) (ii).

A "qualifying person" under Regulation 5 (f) is a director, manager or other similar officer of a corporate services provider who has a qualification -

(ii) accredited by the Qualifications and credit Framework as a Level 7 or 8 (MSc or PhD) qualification in:

-Financial services or

-Economics or

-Corporate governance.

Rule made under Regulation 5 (f) (iii)

A "qualifying person" under Regulation 5 (f) is a director, manager or other similar officer of a corporate services provider who has a qualification -

(iii) which has been specified in rules made by the Registrar

- MBA Chartered Banker.

- ACCA in Accountancy.

In addition to the qualifying criteria, Agents will need to have attended an Image Rights training course. Under Regulation 5(4)(d)  rules made under these regulations require Agents to attend the Image Rights Registered Agent training seminar provided by the Registrar and staff at the Intellectual Property Office.

Erasure, suspension and refusal to recognise an agent

The Registrar may erase from the Register the name of any person registered in it, or suspend a person's registration on the grounds that the person, in the opinion of the Registrar, has breached or failed to observe the rules of professional conduct of a code of practice for Registered Image Rights Agents when such code is agreed.
